| Summary, etc. | Comme elle nous a accoutumé en matière de contentieux environnemental, la Cour de Strasbourg continue de naviguer entre « activisme judiciaire et excessif self-restraint » (selon l’expression employée par Jean-Paul Costa, in La Cour européenne des droits de l’Homme, Conférence donnée à l’Académie des Sciences Morales et Politiques à l’Institut de France, Paris, le 25 janvier 2016). D’une part, il faut saluer son très bel arrêt CEDH 6 octobre 2016, Malfatto et Mieille c/ France (non violation de l’article 1er du protocole n˚ 1) qui valide la conventionnalité du principe de non indemnisation de servitudes d’urbanisme protectrices du littoral, du fait de l’absence de rupture d’équilibre entre les droits des requérants et l’intérêt général de la communauté. D’autre part, ses décisions d’irrecevabilité CEDH (déc.) 24 mars 2015, Viviani et autres c/ Italie (non épuisement des voies de recours internes, article 35 §§ 1 et 4 de la Convention) et Smaltini c/ Italie (défaut manifeste de fondement, article 35 §§3 et 4 de la Convention) illustrent à l’inverse la drastique sélection des affaires environnementales, les requérants étant parfois insuffisamment éclairés ou conseillés (1ère affaire) ou confrontés à l’application par la Cour de Strasbourg d’une conception trop archaïque du lien de causalité (2ème affaire). |

| Summary, etc. | Environmental cases of the European Court of Human Rights (2015-2016)As we have come to expect from the European court of human rights, the environmental dispute varies strongly from “judicial activism to excessive self-restraint” (in the terms used by the Judge Jean-Paul Costa). On the one hand, we must welcome its judgement in the case Malfatto and Mieille v/ France, ECHR 6 October 2016 (no violation of Article 1 of Protocol n˚1) where the applicants alleged that the refusal of their claims for compensation amounted to a violation of their right to respect of property. The Court considered that the balance between the applicants’ rights and the general interest of the community, which encompassed the legitimate aim of the protection of coastal areas, had not been upset. On the other hand, we can deplore that there’s a drastic selection of environmental applications. In the decision Viviani and others v. Italy, ECHR 24 March 2015, the Court declared inadmissible an application complaining of a lack of protection and information regarding the risks attached to a possible eruption of Vesuvius; in the decision Smaltini v. Italy, ECHR 24 March 2015, the Court also declares inadmissible case concerning complaint that polluting factory emissions caused leukaemia. |
