| Summary, etc. | Le cinquième anniversaire de la loi sur le devoir de vigilance est l’occasion de revenir sur la (grande) difficulté procédurale mise en lumière par les premiers contentieux. Le législateur n’avait pas précisé ce qu’il fallait entendre par « juridiction compétente » pour connaître des actions portant sur le devoir de vigilance. Plusieurs décisions s’en sont suivies, affirmant parfois des solutions contradictoires : tantôt on retenait la compétence du juge judiciaire, tantôt celle du juge consulaire. Les débats sur le fond des litiges n’ont jamais eu lieu, malgré l’urgence des problèmes évoqués (violations des droits humains, atteintes à l’environnement et au climat). Le législateur a alors décidé d’intervenir pour confier au seul Tribunal judiciaire de Paris la mise en œuvre desdites actions. |

| Summary, etc. | The fifth anniversary of the French duty of vigilance Act is an opportunity to recall the high procedural difficulties highlighted by the first disputes, considering that the law did not specify which jurisdiction had the competence to receive such actions. Several decisions followed, affirming contradictory interpretations. Discussions on the substance of the claims have never taken place, despite the emergency of the issues raised (violations of human rights, environmental and climate degradations). Eventually, the legislator decided to intervene to entrust the Civil Court of Paris with the implementation of these actions. |
