| Summary, etc. | La planification urbanistique a fait l’objet, en 2021, de nombreuses évolutions visant à la prise en compte des objectifs environnementaux. On a ainsi pu voir des réflexions sur les friches industrielles, sur le nouveau « Patrimoine sensoriel des campagnes françaises », ainsi que l’annulation de plusieurs PLU intercommunaux pour des raisons environnementales. De la souplesse a aussi été introduite avec des possibilités de construire dans les zones inconstructibles, mais seulement pour des annexes de bâtiments, ou encore sur la notion de logement social distinct de la notion d’hébergement. Le contrôle sur les études d’impact a, lui aussi, été précisé, notamment sur la qualité des études scientifiques qui en sont le support. Enfin, le contentieux de l’urbanisme a bénéficié de plusieurs précisions concernant les articles L. 600-5 et L. 600-5-1 C. urb., une série de jurisprudences encadrant ces obligations soit de rectifier un permis annulé partiellement, soit de suspendre le jugement afin d’effectuer la rectification en cours d’instance permettent de mieux en voir les contours. |

| Summary, etc. | During 2021, urban planning evolved towards a better understanding of environmental objectives. It led to reflections on industrial wastelands, on the new "Sensory heritage of the French Countryside" and to the invalisation of several inter-municipal land planning documents for environmental reasons. However, the judge recognized the possibility to build in unbuildable areas, but only for annexes to buildings, and differentiated the notion of social housing from accommodation. The control over Environmental impact assessment has also been clarified, particularly with regard to the quality of the scientific studies that support them. At last, several clarifications have been made to urban planning litigation regarding articles L. 600-5 and L. 600-5-1 of the urban Code: series of cases framing these obligations to rectify either a partially invalidated permit or to suspend the effect of the court decision in order to carry out the rectification during the course of the proceedings allows a better understanding of these procedures. |
