| Summary, etc. | Différentes évolutions législatives et jurisprudentielles ont marqué l’année 2021 pour ce qui est des procédures de participation du public aux décisions en matière d’environnement. On relèvera tout d’abord qu’une fois de plus s’est posée la question de la constitutionnalité et de la conventionnalité du droit de la participation du public au regard de l’article 7 de la Charte de l’environnement et de l’article 6 §4 de la Convention d’Aarhus. On relèvera ensuite, que les procédures du débat public et de la concertation préalable ont fait l’objet de différentes modifications législatives et réglementaires sans que celles-ci aient eu pour effet de bouleverser le droit en vigueur. On relèvera enfin, s’agissant de l’enquête publique, qu’aucune évolution législative ou réglementaire notable n’a eu lieu en 2021. La jurisprudence administrative a néanmoins apporté des précisions intéressantes en ce qui concerne les enquêtes publiques relatives aux documents d’urbanisme : dès lors qu’elles ne portent pas atteinte à la pertinence des avis rendus non plus qu’à l’information du public, les modifications apportées au projet de plan avant et après l’enquête publique ne sont pas illégales et peuvent au contraire contribuer à renforcer l’effectivité de cette procédure participative. |

| Summary, etc. | 2021 has been rhythmed by the evolutions of the law and jurisprudence regarding public participation’s procedure to environmental decisions. Once again the constitutionality and conventionality of these procedures was questioned towards the article 7 of the Environmental Chart and article 6§4 of the Aarhus Convention. Then, public debate and concertation procedures have been modified without great changes. At last, the public enquiry mechanism remained the same. Nevertheless, administrative jurisprudence clarified the impact of public enquiries on urban planning documents: within the frame of public information, modifications can be made before and after the enquiry and can strengthen the efficiency of this participatory procedure. |
