| Summary, etc. | La jurisprudence rendue sur la période s’étendant de janvier 2019 à décembre 2021 est, de manière générale, révélatrice de la volonté d’assurer tant bien que mal, avec les outils juridiques à disposition, une protection pénale renforcée de l’environnement. Cette volonté conduit le juge, pragmatique, à prendre des libertés à l’égard des grands principes du droit pénal en ce qui concerne la qualification pénale des faits et les conditions de la responsabilité pénale. Au contraire, le rigorisme est de mise lorsqu’il s’agit de fixer les sanctions accompagnant les condamnations prononcées. Ainsi, dans le contexte particulier de l’urgence écologique, le droit positif suit-il les évolutions générales d’un droit de l’environnement particulièrement complexe et toujours mouvant. |
