| Summary, etc. | Alors que les condamnations d’États pour méconnaissance de leurs obligations internationales en matière de limitation du réchauffement climatique se multiplient devant les juges nationaux, à l’image de « l’Affaire du Siècle » en France, l’inertie des juridictions européennes interroge. De récentes affaires portées devant la Cour de justice de l’Union européenne et la Cour européenne des droits de l’homme ont pourtant donné l’opportunité à ces juges de prendre part à ce mouvement. Or, ces juges font des conditions de recevabilité un obstacle difficilement surmontable. Si la Cour de justice de l’Union européenne a d’ores et déjà fermé la porte de son prétoire, la Cour européenne des droits de l’homme pourrait accepter d’assouplir sa jurisprudence. |

| Summary, etc. | While the number of judgments against States for breaching their international obligations to mitigate global warming is rising before national judges, such as the "Affaire du Siècle" in France, the inertia of European courts questions.
