| Summary, etc. | Résumé La justice peut imposer des soins aux auteurs d’actes de délinquance, mineurs ou majeurs, ainsi qu’aux enfants en danger et à leurs parents. Selon le cas, les soins sont imposés pour prévenir la récidive ou protéger un enfant. Ils sont aussi l’occasion pour les enfants de bénéficier d’un accès aux soins dont ils auraient autrement été privés, et offrent une alternative au placement d’un enfant hors de sa famille et à l’incarcération des délinquants. Suivent les différents cadres juridiques dans lesquels des soins peuvent être imposés, l’articulation du rôle du juge et du médecin telle que prévue par la loi et les difficultés pratiques qu’elle peut présenter. En matière pénale sont évoquées l’injonction thérapeutique des auteurs d’infraction à la législation sur les stupéfiants, l’obligation de soins imposée dans le cadre d’un contrôle judiciaire ou d’une mise à l’épreuve et l’injonction de soins en réponse à une infraction à caractère sexuel, la souplesse de la procédure et la spécialisation des acteurs permettant une application adaptée aux mineurs. En matière de protection de l’enfance, le placement d’un enfant en hôpital psychiatrique et le maintien d’un enfant dans sa famille sous conditions soulèvent des questions particulières. |

| Summary, etc. | Courts can impose medical or psychiatric treatment to young and grown-up offenders as well as to children at risk and their parents. According to the situation, compulsory treatment can therefore be ordered by courts, either to prevent a subsequent offence or to protect a child. Such decision is also an opportunity for children to take advantage of a psychiatric treatment that otherwise they would not have had. It is also an alternative solution to the assignment of a child to a special institution, away from his family, and to the imprisonment of the offenders. This article describes the legal framework of compulsory medical or psychiatric treatment imposed by courts in France, how judges, doctors and psychologists work together in respect of the law, and the practical difficulties they meet. Under a penal perspective, this article gives a broad view about therapist injunction for drugs dealers, the care treatment obligation following a judicial supervising or a probation period, as well as therapist injunction following sexual offences. With regards to the child protection, assignment to a psychiatric hospital and maintaining a child with his family under specific conditions, raise ethical issues. |
