Summary, etc. | La politique allemande de renseignement est-elle marquée par le sceau du « Sonderweg » (l’exception) ? Étroitement contrôlés, les services allemands pâtissent pourtant de l’un des plus faibles taux de confiance en Europe. Second paradoxe, alors que leurs budgets augmentent, les services brillent par leur absence au sein de la « stratégie de sécurité nationale » du gouvernement fédéral rendue publique en 2021. Ce positionnement bancal résulte de plusieurs composantes. La première est historique : le renseignement n’a jamais constitué un élément clé pour la survie de la nation allemande. En outre, la présence des forces américaines depuis les années 1950 n’a pas incité à renforcer le dispositif de renseignement. La seconde est politique : chaque acteur politique souhaite appliquer sa marque sur la question du renseignement, véritable précipité des rapports de pouvoir. Les Länder ont ainsi imposé une gouvernance éclatée du renseignement intérieur. La loi sur le renseignement extérieur en 2016, marquée par le traumatisme de l’affaire Snowden (2013), a réaffirmé les pouvoirs de la commission de contrôle parlementaire (PKGr). Enfin, le poids de la Cour constitutionnelle est majeur dans l’encadrement strict des services ; elle a ainsi percuté la mise en oeuvre des capacités de surveillance électronique. De fait, le renseignement se glisse au coeur des débats politiques, certains journalistes et responsables politiques estimant une réforme indispensable pour bâtir une puissance en la matière à la hauteur du pays. |

Summary, etc. | Is German intelligence policy stamped with the seal of the “ Sonderweg” (the special path)? Although tightly controlled, the German intelligence services suffer one of the lowest levels of public trust in Europe. In a second paradox, although their budgets were increased, the services were conspicuously absent from the federal government’s 2021 “National Security Strategy.” There are several reasons for this inconsistent positioning. The first is historical: intelligence has never been a key factor in the survival of the German nation. What is more, the presence of American forces in the country since the 1950s has disincentivized any strengthening of the nation’s intelligence apparatus. The second is political: every political actor wants to make their mark on intelligence, making it a focal point of power relations. The Länder have therefore brought about a fragmented governance of domestic intelligence. The 2016 law on foreign intelligence, influenced by the trauma of the Snowden affair (2013), reaffirmed the powers of the Parliamentary Oversight Panel (PKGr). Finally, the Federal Constitutional Court carries a great deal of weight in the strict supervision of the intelligence services; this has had an impact on the implementation of electronic surveillance capabilities. In fact, intelligence has come to the fore of political debate, with some journalists and politicians arguing that reform is essential in order to build an intelligence power worthy of the country. |
