| Summary, etc. | Les coutumiers normands du Moyen Âge valorisent particulièrement la résolution des litiges par la « voie de cour », qui confie aux personnes en charge de la justice le soin de trancher les différends au terme d’un procès. Ce constat n’est pas nouveau : il transparaît en particulier dans certains travaux de Jean Yver. La présente étude revient sur la prédominance du traitement judiciaire des conflits dans les usages normands du xiiie siècle en scrutant les dispositions du Très ancien coutumier de Normandie et de la Summa de legibus Normannie in curia laicali. Cette démarche permet non seulement de confirmer en les synthétisant nombre d’analyses effectuées par les chercheurs durant les dernières décennies, mais également de les enrichir par des réflexions nouvelles, en particulier en mettant en valeur certains passages qui, dans les coutumiers précités, n’ont guère été utilisés concernant la problématique envisagée. Cet article permet également de compléter les travaux plus anciens en mettant davantage en perspective les solutions normandes avec celles mises en œuvre, à la même époque, dans le reste du royaume. |

| Summary, etc. | The Norman custumals of the Middle Ages particularly value the resolution of disputes by the “ voie de cour”, which entrusts those in charge of justice with the care of settling disputes after a trial. This observation is not new: it is reflected in particular in certain works by Jean Yver. The present study reviews to the predominance of the judicial treatment of conflicts in the Norman customs of the 13th century by examining the provisions of the Très ancien coutumier de Normandie and the Summa de legibus Normannie in curia laicali. This approach not only makes it possible to confirm – by synthesizing them – the number of studies carried out by researchers over the last decades, but also to enrich them with new thinking, in particular by highlighting certain passages which, in the aforementioned custumals, have hardly been used concerning this intended issue. This article also makes it possible to supplement older works by putting more into perspective the Norman solutions with those implemented, at the same time, in the rest of the kingdom. |
