Summary, etc. Cet article explore la question du consentement des personnes vulnérables et de la démarche éthique qui vise à favoriser son expression libre et éclairée. En présentant quelques considérations étymologiques et en se basant sur la pensée philosophique d’Aristote, de Kant et de Mill, il cherche à proposer un cadre conceptuel aux institutions désireuses de penser leurs pratiques.Par cet étayage, il souhaite montrer que le consentement n’est que l’avers d’une pièce constituée d’un revers prenant la forme de l’assentiment. Consentir est une décision, assentir est l’implication personnelle sur le chemin singulier menant à celle-ci. Les deux doivent donc être abordés ensemble, ce qui peut être soutenu par la pensée aristotélicienne (l’acte en tant que tel), par la pensée kantienne (l’acte en tant qu’expression de la volonté), et enfin au travers des jalons de Mill au sujet de ce qui constitue la légitimité d’une contrainte.

Summary, etc. This article explores the vulnerable person’s consent and the ethical approach to improve its deliberate and informed expression. With the presentation of a few etymological considerations and based on the thinking of Aristotle, Kant and Mill, the purpose is to offer a conceptual framework for institutions who wish to engage in thinking about their practice. Consent is a decision, assent is the personal implication on the singular path leading to it. Both consent and assent should be appreciated together, an idea that can be supported by Aristotlelian’s thinking (in his theory of action), by Kant (who conceived action as an expression of the will), and by John Stuart Mill who defines the stages of thought that lead to determining what constitutes legitimate constraint.
