| Summary, etc. | La protection juridique des majeurs est un sujet transverse qui touche à l’autonomie dans la vie quotidienne des personnes en situation de vulnérabilité et aux solidarités. Elle comporte de forts enjeux de société. Notre dispositif national, très ancré dans le droit civil, a intégré le champ social et médico-social depuis plus de dix ans. Aussi les pratiques professionnelles des mjpm ont de fait emprunté au travail social. Progressivement, la justice civile, garante des libertés et des droits fondamentaux, avec l’intervention du juge, marque un recul.La mission de protection est toujours mal comprise y compris du corps social. Les idées reçues continuent d’alimenter l’imaginaire collectif et d’ignorer les évolutions des droits des personnes protégées. Il convient donc de mieux faire connaître ce sujet qui touche aussi bien à l’intime qu’au politique. Depuis une dizaine d’années, de nombreuses initiatives y concourent. Ayons donc l’ambition d’améliorer notre dispositif national, en vue de rendre les droits des personnes plus effectifs. Les perspectives internationales ne doivent pas devenir des injonctions, mais nous rappeler qu’il devient urgent d’optimiser la mise en œuvre de notre droit positif. |

| Summary, etc. | The legal protection of adults is a cross-disciplinary subject that affects the autonomy in the daily life of vulnerable people and solidarity. It involves major social issues. Our national system, which is very much rooted in civil law, has encompassed the social and medico-social field for over ten years. The professional practices of the family mediation services have also borrowed from social work. Civil justice requiring the intervention of a judge, the guarantor of fundamental rights and freedoms, is gradually decreasing in importance.The mission of protection is still poorly understood, even by the social body as a whole. Preconceived ideas continue to feed the collective imagination and ignore the evolution of the rights of protected persons. It is therefore necessary to raise awareness of this cross-disciplinary subject, which touches on both the intimate and the political. For the past ten years, many initiatives have been working towards this goal. Let us therefore have the ambition to improve our national system, with a view to making the rights of individuals more effective. International perspectives should not become injunctions, but remind us that it is becoming urgent to optimize the implementation of our positive law. |
