| Summary, etc. | Mondialisation et droit internationalL’évolution du droit international a montré depuis plus de cent ans deux modalités d’ouverture vers des facteurs d’ « interdépendance ». D’abord un mouvement vers l’universalisation ratione personae et materiae du droit, en incluant en son sein de nouvelles personnes dotées de droits et de devoirs ainsi qu’en couvrant une série de nouvelles matières. Mais il a aussi subi un mouvement de mondialisation consistant en ceci que l’écran entre la société interne et la société internationale a progressivement été estompé et qu’il y a de larges pans du droit qui se recomposent en des ensembles nouveaux fusionnant du droit interne et du droit international et constituant ainsi une espèce de droit transnational mondial auquel participent des millions d’acteurs de la société civile. Il se constitue là une espèce de droit fédéral mondial sans fédération politique. |

| Summary, etc. | Mondialisation et droit internationalInternational law in the last two centuries evolved towards a better reflection of interdependence. First, it went its way towards a universal system by including new subjects of the law and by covering a whole range of new fields. Second, it was subjected to the forces of globalization by piercing progressively the screen separating international law from national law. Thus, new areas of the law constituted themselves by way of a complex blend of internal and international law. One can therefore speak of the emergence of a new type of transnational law in which millions of actors of civil society are participating. Hence, a sort of world federal law is taking shape, but it remains devoid of any type of political federalism. |
