| Summary, etc. | L’espace extra-atmosphérique définit un domaine très particulier, tant du point de vue physique que du point de vue de ses usages. Son caractère global, éminemment collectif et partagé, spécificité consacrée par le droit international, font de l’espace l’un des meilleurs candidats au titre « d’espace commun ». Pour autant, l’espace n’est pas exempt de rapports de force à caractère militaire, industriel ou commercial. Pendant les décennies de guerre froide, l’affrontement bipolaire avait cependant contribué à sanctuariser l’espace. Aucune des deux grandes puissances n’avait alors intérêt à déstabiliser l’équilibre spatial, élément crucial de l’équilibre stratégique plus large. Les temps ont changé et les années récentes ont montré un intérêt militaire renouvelé pour utiliser l’espace. L’évolution des technologies et l’irruption de nouveaux acteurs confèrent aussi une dynamique nouvelle à l’activité spatiale qui met aujourd’hui en débat le statut de l’espace extra-atmosphérique. |

| Summary, etc. | Outer space has remained a highly specific environment, either regarding its physical properties or its different uses. Global by nature, outer space has appeared as a collective and shared endeavour as testified in space treaties. As such, outer space has provided the perfect example of the often mentioned notion of ‟global commons”. However, the history of space has been nourished by military, industrial or commercial competitions. Simply, during the Cold War years, the two superpowers have made space a sanctuary with the goal to preserve a form of stability that was to play a key role in ensuring a more general strategic balance. Space helped deal with the mutual nuclear threat. Times have changed. First a new military interest for using space systems has developed over the recent years. But also, new entrants, whether governments or private industries, have changed the dynamics of space. These new developments have been at the heart of a rising debate regarding possible changes in the legal and political status of outer space. |
