| Summary, etc. | L’échec du Pacte mondial pour l’environnement à Nairobi en 2019 permet de faire progresser deux autres initiatives de la société civile : la Déclaration des droits de l’humanité et le troisième Pacte des droits de l’Homme. Cet article s’intéresse à ce second projet. Son but est d’inscrire la reconnaissance universelle du droit des êtres humains à l’environnement, non pas dans un nouveau traité sur l’environnement, mais dans un nouveau traité sur les droits de l’Homme. Cette idée est ancienne. De plus, le droit à l’environnement est déjà consacré dans des instruments régionaux. Ce troisième Pacte n’a pas pour objectif d’introduire dans le droit international de nouveaux concepts mais de prendre acte des acquis et d’empêcher toute régression des droits liés à l’environnement. Avec ce projet de troisième Pacte, on renforce les droits liés à l’environnement en les rattachant étroitement aux droits de l’Homme tout en évitant un alourdissement des structures existantes. |

| Summary, etc. | The failure of the Global Pact on the environment in Nairobi in 2019 leads to push forward two other civil society’s initiatives: the Declaration of Humankind Rights and the Third International Covenant on the Human Right. This article is related to the second one. The purpose is to recognize the universal right on the human right to the environment into a new human rights treaty, and not into a new environmental one. This is an old idea. The Environmental Law has been already recognized by regional legal instruments. The purpose of this Third Covenant is to note the achievements and to prevent regression of rights related to the environment. With this draft, the rights related to the environment are strengthened thanks to their closed connection to the human rights, whilst avoiding to increase the existing structures burden. |
