| Summary, etc. | La démocratisation de la pratique de la pêche à l’aimant dans les cours d’eau suscite à la fois intérêt et réticences. Les considérations inhérentes à la protection de l’environnement, avancées par de nombreux pratiquants, doivent être, du point de vue des personnes publiques et des gestionnaires des cours d’eau, fortement relativisées. En l’absence de cadre juridique spécifique, la réglementation de cette pratique impose à la fois de tenir compte des considérations d’ordre public mais aussi de ne pas sous-estimer l’éventuelle application des dispositions du Code du patrimoine relatives à la détection d’objets enfouis. À cette première difficulté s’ajoutent celles relatives à la nature et au régime des produits de cette pêche. Les objets sortis des cours d’eau, selon les conditions de leur découverte mais aussi de leur enfouissement, sont susceptibles d’être assimilés à des déchets, des trésors, des épaves ou même des biens archéologiques. |

The considerations inherent in the protection of the environment put forward by many practitioners, must be strongly relativised from the point of view of public entities and waterway managers. In the absence of a specific legal framework, the regulation of this practice requires consideration of public policy, and the possible application of the provisions of the Heritage Code related to the detection of buried objects must not be underestimated. Difficulties related to the nature and treatment of the objects of magnet fishing must also be considered. Depending on the conditions of their discovery and burial, objects taken out of waterways are likely to be equated with waste, treasures, shipwrecks or even archaeological objects. |
