| Summary, etc. | L’explosion de l’usine Lubrizol à Rouen, installation Seveso seuil haut, suscite, comme c’est généralement le cas de tels événements, beaucoup d’interrogations liées notamment à l’application du droit de l’environnement industriel et de la gestion de crise. Dans un contexte où l’assouplissement des règles est un des maîtres mots, un tel accident majeur conduit à réinterroger leur effectivité de ces règles. Pour le reste, la jurisprudence administrative a appliqué aux ICPE les solutions dégagées par ailleurs concernant l’autorisation environnementale ou la compatibilité avec les SCOT et PLU.On observe une accentuation des tensions entre intérêts antagonistes en matière de protection de l’environnement contre les pollutions. Les droits fondamentaux reviennent dans plusieurs grands arbitrages, et le principe de précaution donne lieu à un large éventail de jurisprudences. À l’image du contentieux de la pollution atmosphérique, la question centrale qui se pose est la suivante : qui est responsable des phénomènes diffus et multifactoriels qui, avec le changement climatique, risquent de se multiplier ? |

| Summary, etc. | The explosion of the Lubrizol factory in Rouen, a Seveso high threshold installation rises, as it is generally the case with such events, many questions related in particular to the application of industrial and environmental law and crisis management. In a context where more flexible rules seem to be the key, such a major accident leads to re-questioning the effectiveness of environmental rules. Apart of this, administrative jurisdictions have applied to industrial plants solutions identified elsewhere concerning e.g. environmental authorization or compatibility with land planning documents.There are increasing tensions between several competing interests in environmental protection. Human rights are at the center of several court decisions, and the precautionary principle gives rise to a wide range of case law. Like the air pollution litigation, the central question is: who is responsible for the diffuse and multifactorial phenomena which, with climate change, will multiply ? |
