| Summary, etc. | La problématique – récurrente – des risques naturels côtiers a fait l’objet de plusieurs rapports. La question de la recomposition spatiale des territoires littoraux face au recul du trait de côte est ainsi posée mais les réponses juridiques demeurent difficiles à élaborer, notamment s’agissant de l’indemnisation éventuelle des propriétaires impactés. Concernant l’urbanisme, la loi ELAN du 23 novembre 2018 ayant assoupli le principe d’extension en continuité de l’urbanisation (issu de la loi Littoral), il convient d’être attentif à sa traduction dans les documents d’urbanisme et à son application par le juge administratif. Aujourd’hui, comment distinguer clairement un hameau éligible au dispositif de la loi ELAN d’un village ? Le droit de la domanialité publique, pour sa part, demeure encore un élément stable de la protection du domaine public maritime naturel.Le contentieux de l’installation des parcs éoliens en mer et la planification des énergies renouvelables marines font encore une fois l’actualité. On peut penser que ce contentieux va se réduire à l’avenir, la procédure en vue de cette installation ayant de nouveau été modifiée. Si la pollution maritime par les hydrocarbures reste – malheureusement – elle aussi d’actualité, l’année 2019 a permis d’avancer sur la question de la pollution atmosphérique causée par les navires. |

| Summary, etc. | Several reports have meaningfully dealt with the problem of natural coastal hazards. The issue of spatial the recomposition of the coastal territories regarding the coastal line which is losing ground is thus raised but the legal answers remain difficult to give, particularly as regards the potential allowances for the affected owners. As regards urban law, the ELAN Act of November 23, 2018 has eased the principle of extension in continuity of urbanization (stemming from the Littoral law), therefore, attention should be paid to its implementation in the town planning documents and to its interpretation by the administrative judge. Today, how can we clearly distinguish a hamlet eligible for the ELAN scheme from a village? The public domain law, for its part, still remains a stable element of the protection of the natural marine public domain.Litigation over the installation of offshore wind farms and the planning of marine renewable energy are once again in the news. It can be expected that this litigation will be reduced in the future, as the procedure for such installation has again been modified. While maritime oil pollution at sea remains – unfortunately – also topical, the year 2019 has brought progress on the issue of air pollution caused by ships. |
