Summary, etc. La Cour d’appel de Tunis a confirmé que « le dommage environnemental constitue une dégradation ou une atteinte à l’environnement » et, par conséquent, on ne peut pas lui appliquer les règles classiques de la responsabilité.Ce constat très pertinent n’a, hélas, pas été suivi par la justice administrative, qui, malgré la reconnaissance constitutionnelle du droit à un environnement sain et équilibré, ne prend pas en considération la spécificité de l’environnement dans le contentieux administratif.En effet, les bases légales, qui servent à engager la responsabilité de l’administration en général (la faute, la présomption de faute, les travaux publics, les charges publiques…), peuvent servir aussi à engager sa responsabilité pour les faits et actes ayant causé un dommage à l’environnement. Toutefois, le dommage écologique, malgré ses spécificités, ne semble bénéficier d’aucun fondement propre.

However, ecological damage, despite its specificities, does not seem to benefit from any specific basis.
