| Summary, etc. | Le Tribunal international du droit de la mer (TIDM), prévu parmi les moyens de règlement des différends en vertu de la partie XV de la Convention des Nations unies sur le droit de la mer (CNUDM), joue un rôle essentiel dans la protection du milieu marin. Dans sa jurisprudence, le TIDM a intégré les développements les plus récents du droit international de l’environnement et, en particulier, a explicitement reconnu la pertinence de certains de ses principes, parmi lesquels le principe de précaution a été particulièrement bien accueilli. Ce travail se concentre sur les cas où l’application du principe de précaution pour la prévention des dommages au milieu marin a été considérée comme une question clé. L’intervention du TIDM a eu lieu, dans le cadre de sa juridiction contentieuse, suite à la demande de mesures conservatoires (art. 290.1 de la CNUDM), ce qui constitue déjà en soi un progrès dans le processus judiciaire international. Les contributions qu’il a apportées à cet égard dans l’exercice de sa compétence consultative sont également notées. |

| Summary, etc. | The International Tribunal for the Law of the Sea (ITLOS), one of the means for the settlement of disputes under Part XV of the United Nations Convention on the Law of the Sea (UNCLOS), plays a key role in the protection of the marine environment. Through its jurisprudence, ITLOS has incorporated the most recent developments in international environmental law and, in particular, has explicitly recognised the relevance of some of its principles. Among them, the precautionary principle has been particularly well received. This paper focuses on cases where the application of the precautionary principle for the prevention of damage to the marine environment has been identified as a key issue. ITLOS’ intervention has taken place, in its contentious jurisdiction, in response to requests for provisional measures (Article 290.1 of UNCLOS), which in itself constitutes a step forward in the international judicial process. The contributions made in this regard in the exercise of its advisory jurisdiction are also noted. |
