| Summary, etc. | Au cours des quarante dernières années, de très nombreuses réformes institutionnelles et normatives ont été effectuées en droit turc. Diverses matières ont été touchées par une vague d’européanisation des politiques, le droit de l’environnement en fait ainsi partie. En reconnaissant à chacun « le droit de vivre dans un environnement sain et équilibré » dans sa Constitution dès 1982, le droit turc a commencé à tisser un cadre juridique beaucoup plus protecteur de l’environnement qu’auparavant. La loi sur l’environnement de 1983 est venue appuyer cette consécration constitutionnelle. Le droit de l’environnement turc, notamment face aux défis du 21e siècle, n’est pourtant pas tout à fait doté des mécanismes et instruments juridiques. L’absence de consécration du principe de précaution en droit turc en constitue un exemple. Cependant, sa mise en œuvre devient possible tant par le biais des réglementations sectorielles que par l’office du juge. |

| Summary, etc. | Over the last forty years, many institutional and normative reforms have been carried out in Turkish law. Various issues have been affected by a wave of the Europeanization of policies, environmental law included. By admitting to everyone "the right to live in a healthy and balanced environment" in its constitution as early as 1982, Turkish law has begun to build a legal framework much more protective of the environment than before. The main legal framework is set out in Environment Act which came into force in 1983 for supporting this constitutional achievement. But, especially considering the challenges of the 21st century, Turkish environmental law is not entirely provided with legal mechanisms and instruments. The non-recognition of the precautionary principle is an example of this. However, the precautionary principle can be enforced both through sectoral regulations and through judgment. |
