Summary, etc. RésuméDes centaines de communautés villageoises, accoutumées à la libre occupation des sols de leur finage et à un contrôle superficiel de l’administration habsbourgeoise, sont confrontées à l’introduction d’une réforme cadastrale de grande ampleur dans les années 1770. Élaborée à Vienne par des administrateurs qui n’ont qu’une expérience fugace de la vie rurale régionale, cette réforme est conçue comme une tentative de modernisation sociale d’institutions retardataires : la famille élargie et la propriété communautaire de la terre. Mais l’étude des préconceptions des fonctionnaires éclairés n’est pas suffisante. La large place attribuée aux soi-disant « caractères nationaux » de l’agriculture régionale dans leurs discussions masque les enjeux politiques et sociaux de cette réforme. Une attention accrue envers l’application négociée de cette nouvelle norme juridique au niveau local est nécessaire. Elle permet alors de s’interroger sur le rôle respectif des normes juridiques garanties et introduites par l’État et les normes sociales et culturelles observables à l’échelle villageoise dans l’organisation de la vie familiale et communautaire.

Village political life and land registry reforms in the Banat villages during the xviiith siècleIn the 1770s, hundreds of village communities, heretofore accustomed to freely occupying the soil of their territory with little if any oversight from the Habsburg administration, were suddenly confronted to the introduction of a far-reaching reform of the land registration system. This reform, conceived in Vienna by administrators with barely any experience of regional rural life, was meant as an attempt at socially modernizing two archaic institutions, the extended family and the collective ownership of land. But studying the preconceived notions of enlightened civil servants is hardly enough here. The recurring stress put on the so-called « national character » of regional agriculture throughout their discussions of the reform was a way to gloss over its political and social stakes. We must pay more attention to the negotiated implementation of this new juridical norm at the local level. Only then will we be able to question the respective influence, on one hand of these juridical norms guaranteed and promoted by the State, on the other hand of the social and cultural norms which can be identified at the village level in the ways family and community life was organized.

Summary, etc. ResumenCentenares de comunidades, acostumbradas a la libre ocupación de los suelos de su término y a un control superficial de la administración austriaca, están confrontados a una reforma catastral de gran amplitud en los años 1770. Elaborada en Viena por administradores que solo tienen una visión fugaz de la vida rural en las provincias, se concibe esta reforma como un intento de modernización social de instituciones atrasadas: la familia amplia y la propiedad comunitaria de la tierra. Pero el estudio de los prejuicios de funcionarios ilustrados no basta: la importancia que se atribuye a supuestos « caracteres nacionales » de la agricultura de la zona en las discusiones esconde los aspectos políticos y sociales de dicha reforma. Hay que prestar más atención a la aplicación negociada de esta nueva norma jurídica a nivel local y regional. Lo que permite entonces cuestionar el papel respectivo de las normas jurídicas garantizadas introducidas por el Estado y de las normas sociales y culturales que se pueden observar a nivel de pueblo en la organización de la vida familiar y comunitaria.
