| Summary, etc. | Résumé Historiquement, réparation et restitution sont deux notions inséparables l’une de l’autre lorsqu’est envisagé le dédommagement de victimes à la suite d’un conflit international. L’exigence de compensation qui, aujourd’hui, se fait entendre à l’échelle planétaire exige de préciser les différences entre l’une et l’autre de ces deux conceptions. Celles-ci sont le fruit d’une histoire qui, dans la modernité, a connu principalement trois moments : la transition westphalienne avec Grotius, les Lumières avec Kant, la première guerre mondiale avec la critique de Carl Schmitt. Aujourd’hui, un demi-siècle après Nuremberg, une ère nouvelle voit le jour, à la faveur de nombreuses demandes de restitution et de compensations individuelles. Cette évolution du droit et de l’économie pose la question morale fondamentale de la compensation financière de la perte humaine dans toute sa singularité. |

| Summary, etc. | As reparations’politics have become one of the most significant dimensions of the post-cold war era, there is a need to better understand the specificity of the financial compensation victims receive after the conflict. The genealogy of post-conflict compensation shows two different aspects related to the same set of practices, reparation and restitution. In order to clarify the differences between the one and the other, we need to discuss three major historical steps : the Westphalian and Grotian transition, the Kantian moment and Carl Schmitt’s critique of Worl War I reparations. This historical and constructivist analysis helps to better understand the post-cold war new regime of truth which privileges restitution vis-à-vis reparations. |
