| Summary, etc. | Au 18e siècle, la théorique juridique et la réalité judiciaire s’affrontent lorsqu’il est question du consentement juvénile. Considérée dans les dictionnaires juridiques comme une victime parfaite – parce qu’innocente par nature –, la fillette dont la famille vient porter plainte doit prouver son innocence au tribunal, face à des juges et des médecins qui remettent en cause l’absence de son consentement et des accusés qui plaident la responsabilité féminine. Par l’analyse d’une vingtaine de procès pour viol issus des archives du Châtelet de Paris (1750-1785), nous avons constaté une méfiance de la part de la justice parisienne à reconnaître l’absence de consentement juvénile : le discours qui décide de la peine est celui de l’accusé et non celui de la victime. |

| Summary, etc. | In the eighteenth century, legal theory and judiciary reality were pitted against each other when it came to juvenile sexual consent. Considered in legal dictionaries as perfect victim (because in-nocent by nature) the girl whose family came to lodge a complaint had to prove her innocence to the tribunal when facing judges and doctors who questioned the absence of her consent as well as accusers who pleaded feminine responsibility. With the analysis of twenty or so trial proce-dures for rape taken from the Châtelet archives in Paris (1750-1785), mistrust is noted on the part of Parisian justice when acknowledging an absence of juvenile consent : the discourse that prevails in the sentencing is that of the accuser, not that of the accused. |
