| Summary, etc. | Dans le § xxviii des Délits et des peines, Beccaria soutient que, dans un État de droit, la peine de mort n’est ni légitime, ni nécessaire, ni utile. Dans un passage qu’il n’est pas facile d’interpréter, il évoque cependant le cas d’un homme qui, quoique prisonnier, constitue pourtant, par ses relations et sa puissance, une telle menace pour la sécurité de la nation que seul l’échafaud représente alors un remède nécessaire. Mais cette situation, qui évoque entre les lignes celle d’un souverain déposé, ne désigne pas un état d’exception où seraient suspendues les règles « normales » de la société politique. Elle décrit plutôt le retour à un véritable « état de guerre », où « les désordres tiennent lieu de lois ». |
