| Summary, etc. | Sur l’idée de la protection continue des zones vertes ou protégées, le principe de non-régression se consolide en Espagne en tant que limite au pouvoir discrétionnaire du planificateur, empêchant la régression de la protection de l’environnement au regard d’une norme d’urbanisme. On dégage des décisions du Tribunal Suprême du 23 février 2012 et du 29 mars 2012, entre autres, qu’on ne peut affecter les espaces protégées que moyennant une motivation spéciale justifiant l’amélioration de l’intérêt général et le respect d’une procédure spécifique et légalement prévue. |

| Summary, etc. | The principle of non-regression in the recent case law of the Supreme Court of Spain : february 22, 2012 (STS 3774/2009) and march 29, 2012 (STS 2000/2012)Based on the idea of a continuous protection of the green or protected areas, the principle of non-regression consolidates in Spain as a limit to the discretionary planning power, preventing the regression of environmental protection by planning rules. The rulings pronounced by the Supreme Court on february 22, 2012 and march 29, 2012, show that protected areas might be affected only in virtue of special reasons that justify the improvement of the public interest, and according to a specific procedure established by the law. |
