| Summary, etc. | Les différents instruments législatifs de l’Union européenne relatifs aux énergies renouvelables illustrent la complexité des relations entre marché et intérêt général au sein de l’UE. Comment la puissance publique européenne articule-t-elle intérêt général et marché ? Une démarche commune unit ces différents textes européens ; une démarche dialectique à vrai dire. Il s’agit tout d’abord de se servir du marché pour réaliser l’intérêt général, en l’occurrence la protection de l’environnement. Dès lors, la promotion des énergies renouvelables déclarée d’intérêt général repose en grande partie sur le marché. Néanmoins, le marché peut mal faire. Dès lors que le marché s’avère insuffisant, faillible, l’Union européenne ne va pas hésiter à intervenir pour infléchir le marché au nom de l’intérêt général. |

How does the European public power articulate the public interest and the market ? Such European laws are united by the way of a dialectical common approach. Firstly, it is about using the market to achieve the public interest, namely the protection of the environment. Therefore, the promotion of renewable energies, as a public interest goal, largely depends on the market. However, the market can do wrong. When the market is insufficient, fallible, the European Union will not hesitate to intervene to inflect it, in the name of the public interest. |
