| Summary, etc. | Avec le « constitutionnalisme vert », la plupart des Constitutions intègrent des préoccupations relatives à l’environnement. Aux premiers abords, la Constitution malgache paraît d’avant-garde en la matière. Dès sa version originaire, en 1959, elle a eu des dispositions relatives à la préservation des ressources naturelles et de l’environnement. Ces dispositions sont régulièrement reprises par les différentes versions de la Constitution, jusqu’à celle actuellement en vigueur. La question se pose de savoir si cette constance de ces dispositions se traduit par une effectivité de la protection. Pour ce faire, l’engagement des autorités sera étudié à l’aune des répartitions des compétences et de la portée normative des dispositions constitutionnelles. |

| Summary, etc. | The protection of the environment in the Constitution of MadagascarFrom the inception of Madagascar’s first Constitution, the Malagasy Constitution has always contained dispositions about natural resources and environmental protection. It could be considered a forefront among all the Constitutions which have greened themselves by adding environmental measures and concerns. However, the constancy of those dispositions in the Malagasy Constitution doesn’t automatically imply their effectiveness. It is necessary then to take a look at what length the authority engagements go. Which level of the State are main decisions taken ? Do the constitutional measures have a real legal scope ? |
