| Summary, etc. | La loi du 2 décembre 2015 et la directive 2015/412 qu’elle transpose ne se résument pas à une énième modification du cadre juridique relatif aux OGM. Elles constituent, au contraire, en particulier du point de vue du principe de précaution, des textes importants à considérer. En effet, en inscrivant, au bénéfice des autorités compétentes (dont les autorités françaises), la possibilité d’interdire ou de restreindre la mise en culture d’OGM pour d’autres motifs que ceux liés à l’existence d’éventuels risques pour l’environnement ou la santé, ils font apparaître une déclinaison nouvelle de ce célèbre principe à propos de laquelle, nécessairement, toute une série d’interrogations émergent. |

| Summary, etc. | The directive 2015/412 and the law of 2nd December 2015 that transposes it, are not just another modification of the legal framework relative to GMO. On the contrary, they constitute major legal texts to be considered, especially regarding the precautionary principle. Indeed, as they now give the possibility for competent authorities (including French authorities) to restrict or prohibit the cultivation of GMO for other grounds than protection of the environment or health, a new application of this famous principle is emerging and brings a whole new set of questions. |
