| Summary, etc. | Écartant les questions traditionnelles de savoir comment il s’est singularisé dans l’histoire de la doctrine allemande du droit et les raisons qui font de lui l’un des précurseurs de la théorie des actes de langages, la présente étude évalue l’intérêt juridique de l’approche « intuitionniste » de Reinach. L’utilisation conjointe de sa définition de la promesse et des travaux de Jean-Louis Gardies devraient montrer l’impasse théorique et le faible intérêt pratique de son intuitionnisme, et ce faisant contribuer à diriger les recherches phénoménologiques en théorie du droit vers les travaux du Husserl des Idées directrices |

| Summary, etc. | Putting aside the familiar issues of understanding how Reinach stood out in the history of German law doctrine and the reasons which make him one of the precursors of the Speech acts theory, this study attempts to evaluate the judicial interest in his « intuitionist » approach. By using both Reinach’s definition of the promise and the works of Jean-Louis Gardies to show the theoretical impasse and the slight practical interest of his intuitionism it should contribute to directing phenomenological research in law theory towards the late works of Husserl. |
