Summary, etc. RésuméÀ l’époque moderne, des facteurs géopolitiques font du duché de Savoie un petit État singulier à l’existence incertaine. L’instauration de l’ordre et d’une certaine cohésion sociale dépend en grande partie de la justice, contrôlée par le Sénat de Chambéry, cour d’appel créée en 1559 dans la partie proprement savoyarde du duché sur le modèle des parlements français.La politique criminelle sénatoriale connaît une mutation dans les années 1650-1670. Jusqu’au milieu du xviie siècle, la paix sociale repose sur un dialogue permanent entre les justiciables et la cour d’appel, dans le cadre d’une justice de médiation. Après 1650, concentré exclusivement sur l’administration de la justice, le Sénat se montre plus répressif. Les peines afflictives et les bannissements l’emportent sur les amendes. La place de la cour d’appel s’en trouve modifiée. Institution ouverte aux requêtes des plaignants, elle est au cœur de la société au xvie siècle. À partir de 1650, elle opère une migration verticale pour devenir un des rouages de l’appareil d’État au sein d’un dispositif normatif, fondé sur l’exclusion. La politique d’apaisement, qui caractérisait le xvie siècle, fait place à la volonté de discipliner la société, en particulier les violences, les homicides et les agressions étant les crimes les plus poursuivis et les plus sévèrement réprimés.

Summary, etc. In the early modern period, geopolitical factors make the Duché de Savoie a small singular State with an uncertain existence. Re-founded in 1559, torn between the Spanish and the French alliance, situated on the European confessional dislocation line, facing the Protestant Rome, it is divided in two distinct entities on both sides of the Alps. The instauration of order as well as a certain social cohesion partly rely on justice, controlled by the Senate of Chambery, court of appeal created in 1559 in the duchy’s savoyard part built on the model of French parliaments.Based on the statistical analysis of the criminal procedures and registers found in written form, the study shows that the Senate adopts an attitude similar to the inferior courts –at least until the mid-17th century. Condemning little, accepting every request, particularly in terms of intermediary arrests, it enables a constant dialogue with those to be tried, within a justice of mediation. After 1650, exclusively focused on the administration of justice, it becomes more repressive. After the French grande ordonnance of 1670, the 1680s are marked by an effervescence of regulation. In order to stop any delaying tactic, the complaints are rejected. Afflictive penalties and banishments win over fees.The place of the court of appeal changes. Institution opened to the plaintiffs’ requests, it is at the heart of the 16th century society. From 1650 onward, it operates a vertical migration to become central to the State within a normative system based on exclusion. The appeasement policy, which characterized the 16th century, gives way to the will to discipline society, particularly violence. Homicides and aggressions are the most severely prosecuted and repressed crimes, thefts not being criminalized until the second half of the 18th century.
