| Summary, etc. | La pratique des relations sexuelles dans les institutions quelles qu’elles soient, pose toujours problème, mais plus encore dans les institutions psychiatriques du fait de la vulnérabilité des patients accueillis et des altérations éventuelles de leur capacité à consentir. Une décision de justice vient de préciser, d’une part, le statut de la sexualité (qui est une liberté fondamentale participant du droit à l’intimité) et, d’autre part, les hypothèses où ce droit peut être restreint (motivées par des finalités légitimes et devant respecter un principe de proportionnalité). Cette décision juridictionnelle considère qu’il ne peut exister d’interdiction générale et a priori, et que celle-ci doit toujours être adaptée à des situations singulières |

| Summary, etc. | The practice of sexual relations, in whatever institution, is always a problem, but more so in psychiatric institutions because of the vulnerability of the patients who are admitted and changes in their capacity to consent. A recent court decision was clear, on the one hand it considered the status of sexuality (which is a fundamental freedom, i.e. the participant’s right to privacy) and on the other the hypothesis that such a right may be restricted (motivated by legitimate purposes and in compliance with the principle of proportionality). This judicial decision considered that there can be no general prohibition and in principle any restrictions should always be adapted to each individual case. |

| Summary, etc. | Practicar sexo en unas instituciones cualesquiera que sean plantea siempre un problema, pero más aún en las instituciones psiquiátricas por la vulnerabilidad de los pacientes acogidos y las posibles alteraciones de su capacidad para consentir. Un fallo jurisdiccional acaba de puntualizar, por una parte, el estatus de la sexualidad (libertad fundamental participante del derecho a la privacidad), y por otra parte las hipótesis en las que este derecho puede restringirse (con motivo de finalidades legítimas y habiendo de respetar un principio de proporcionalidad). Este fallo jurisdiccional considera que no puede haber prohibición general y a priori, y que la misma debe estar adaptada a unas situaciones singulares. |
