| Summary, etc. | Au cours du xxe siècle, les pratiques scientifiques ont lentement fait des ressources génétiques un bien public circulant plus ou moins librement entre les communautés scientifiques et les nations. Le recours récent aux brevets pour protéger les inventions dans le domaine des biotechnologies a considérablement bouleversé ces pratiques, et ces ressources deviennent de plus en plus des biens marchands privés. Il en résulte aujourd’hui des régimes juridiques internationaux et nationaux hésitant entre le libre accès à la ressource favorisant son appropriation privée (sans contrepartie) et l’accès contractualisé générant des compensations à l’appropriation privée. Le présent article étudie la confrontation mais aussi l’hybridation de ces deux philosophies depuis les années 1990, et illustre par ce biais les défis à relever pour construire la gouvernance de ce bien public mondial face à des brevets donnant des droits très exclusifs sur la ressource. |

| Summary, etc. | Genetic resources : a way to ensure access to a common good, or to compensate its commodification ?During the 20th century, scientific practices positioned genetic resources as a global public good travelling more or less freely between scientists and nations. More recent use of patents to protect inventions from biotechnologies has dramatically changed these practices by turning these resources into private commodities. As a result, several international agreements and national intellectual property regimens currently exist to navigate between a system that would afford free access to the resources by facilitating their appropriation (without counterparts) and a system of contractual access generating trade-offs to exclusive appropriation. This article focuses on the confrontation and also the hybridizing of these two philosophies since the 1990s. It addresses the issue of how to build good governance of these global public goods in light of the very exclusive rights granted by patents. |
