| Summary, etc. | Sir Matthew Hale (1609-1676), célèbre juriste anglais du xviie siècle, a consacré plusieurs ouvrages et manuscrits à la loi naturelle, à la philosophie naturelle et au droit. Dans cet article, nous examinons la conception des notions communes qui se trouve au cœur de sa théorie du droit naturel. Nous montrerons comment cette conception des notions communes, qui trouve ses sources dans la philosophie ancienne et la théologie chrétienne, permet à Hale de clarifier la relation entre le droit naturel et le droit coutumier anglais (common law). | Summary, etc. | Sir Matthew Hale (1609-1676) was a renowned seventeenth-century English judge who authored numerous works on natural law, natural philosophy, and jurisprudence. In this article, we examine the theory of common notions at the heart of Hale’s understanding of natural law. As well as discussing how Hale’s view of common notions had roots in both ancient philosophy and Christian theology, we examine how Hale used common notions to work out the relationship between natural law and English customary law (common law). We show that Hale deployed his theory of common notions to respond to four philosophical questions that were highly contested in seventeenth-century England: to what extent is law rational, and whose reason did it derive from? To what extent is law universally obliging, and in what ways is it universally obliging? |
