| Summary, etc. | RésuméCet article interroge l’expression et le concept de procès hors norme. Sémantiquement, il est défendu que l’expression doit être abandonnée, pour trois raisons : 1) elle est ambiguë parce que riche d’au moins deux sens, statistique et prescriptif ; 2) en son sens statistique, elle charrie une implication problématique ; 3) en son sens prescriptif, elle est oxymorique, aucun procès ne pouvant être « hors norme ». Conceptuellement, alliant approches en extension et en intension, l’article développe une définition plus précise de ces procès. À l’aune de celle-ci, il est proposé de préférer à l’expression de « procès hors norme » celle de « procès crucial ». |

| Summary, etc. | SummaryThis article examines both the expression and the concept of an "out of the norm trial". At a semantic level, I argue that the expression should be abandoned for three reasons: 1) it is ambiguous as it can have at least two meanings, statistical and prescriptive ; 2) in its statistical sense, it carries a problematic implication ; 3) in its prescriptive sense, it is oxymoric, as no trial can be out of the norm. At a conceptuel level, combining extensional and intensional approaches, I offer a more precise definition of such trials. Accordingly, I suggest we should prefer the expression of "crucial trials". |
