| Summary, etc. | Les juristes humanistes du xvie siècle ont développé une épistémologie sociale des opinions communes en établissant une analogie entre la formation d’un consensus parmi les juristes et la formation de l’opinion publique. L’analogie visait à indiquer que les deux types de croyances de groupe devaient être analysés en termes de témoignage collectif. D’une part, ces deux formes de consensus sont menacées par des pathologies du témoignage. D’autre part, on estime qu’elles conduisent dans le meilleur des cas à des présomptions qui nous aident à agir sur le fondement de ce qui est provisoirement tenu pour vrai. Les croyances collectives des deux types sont considérées comme rationnelles lorsqu’elles possèdent une « vraisemblance » (c’est-à-dire un lien fort avec les hypothèses admises concernant la nature humaine). |

| Summary, etc. | The sixteenth-century legal humanists developed a social epistemology of common opinions by drawing analogies between consensus formation among jurists and the formation of public opinion. The analogy was meant to suggest that both kinds of group beliefs should be analyzed in terms of collective testimony. Both types of consensus formation were seen as threatened by pathologies of testimony. At best, they were regarded as leading to presumptions that help us to act based on what is provisionally taken to be true. Group beliefs of both kinds were taken to be rational when they possess verisimilitude (understood as the relationship in which they stand to assumptions concerning human nature). |
