| Summary, etc. | L’innovation juridique est un objet peu étudié par la doctrine juridique environnementaliste française. À notre connaissance, seuls deux articles publiés par Gilles J. Martin traitent de ce sujet, en définissant le concept et en recherchant des manifestations d’innovations dans le droit positif. Néanmoins, ces articles ne recherchent pas l’intérêt des innovations juridiques pour améliorer la protection de l’environnement. En ce sens, cet article cherche à démontrer l’hypothèse selon laquelle il est d’abord nécessaire d’évaluer les effets du droit pour évaluer dans un second temps l’intérêt d’une innovation donnée (comme les droits de la nature). À cette fin, la recherche empirique a un rôle capital à jouer en ce qu’elle peut permettre d’évaluer les effets du droit de l’environnement et d’identifier les mécanismes producteurs desdits effets. Par ailleurs, l’évaluation des effets du droit peut aider à penser ex ante l’intérêt d’une innovation ainsi qu’à des évolutions du droit moins incertaines consistant à adapter des instruments existants. |

| Summary, etc. | Legal innovation is a subject little studied by French environmentalist legal scholarship. To our knowledge, only two articles published by Gilles J. Martin deal with this subject, defining it and looking for manifestations of innovation in existing law. However, these articles do not explore the value of legal innovations in improving environmental protection. In this sense, this article seeks to demonstrate the hypothesis that it is first necessary to evaluate the effects of the law to subsequently assess the value of a given innovation (such as the rights of nature). To this end, empirical research has a vital role to play in that it enables the assessment of the effects of environmental law and identify the mechanisms that produce these effects. Evaluating the effects of the law can also help to assess ex ante the value of an innovation, as well as less uncertain changes to the law by adapting existing instruments. |
