Paradoxalement, c’est dans ce contexte que le Parlement a su trouver une majorité pour autoriser la substitution de la participation du public par voie électronique à la procédure d’enquête publique dans le cadre de l’élaboration et de l’évolution des documents d’urbanisme. Sur le plan jurisprudentiel, le juge administratif confirme une interprétation restrictive du champ de la participation du public, excluant les décisions de cadrage juridiques. Dans le même temps, il s’efforce également de préciser les effets contentieux de l’enquête publique tout en continuant à garantir l’effectivité de cette procédure. |

Paradoxically, it is in this context that Parliament managed to secure a majority to make the public inquiry procedure optional for the development and evolution of urban planning documents. In terms of case law, the administrative courts confirm a restrictive interpretation of the scope of public participation, excluding decisions that establish legal frameworks. At the same time, they are also striving to clarify the legal implications of the public inquiry while continuing to guarantee the effectiveness of this procedure. |
