Summary, etc. | This article reconsiders the analysis in terms of “judiciarisation” stressing that every social sector or every legal field are not touched in a uniform way by those processes. The asbestos issue, as an occupational toxic controlled by the social law, is a significant example of problem managing rarely of interest to the courts. Beyond the analysis of the reasons explaining the weak “judiciarisation” of this problem, this article analyzes the process by which asbestos acquires the statute of problem likely to receive a legal translation. The mobilizations of victims and the work of several associations play here a central part. |
