| Summary, etc. | Cet article vise à reconsidérer l’analyse économique de la prévention des risques technologiques (majeurs) via la responsabilité civile, dans une perspective de changement technologique : les firmes peuvent innover pour améliorer l’efficacité de leur technologie de prévention. Nous nous inspirons de travaux en économie de l’environnement d’Endres et alii (2006, 2008) tout en intégrant deux spécificités de l’analyse des risques majeurs : l’insolvabilité ex post et la possibilité de concevoir des innovations “à double impact” (réduisant le coût de prévention et la probabilité d’accident). Contrairement à Endres et alii, nous montrons que, dans ce contexte, responsabilité sans faute et règle de négligence induisent des comportements différents, l’efficience de cette dernière dépendant du type d’innovation et du comportement du régulateur. |

| Summary, etc. | Preventing Technological Risks with the Civil Liability System in a Context of Double Impact Innovation We reconsider the economic analysis of (major) technological risks via the civil liability system, in a perspective that includes the possibility of technological change: firms can innovate to obtain a more efficient risk prevention technology. We use analyses from environmental economics (Endres et alii, 2006, 2008) and include two characteristics inherent in the analysis of major risks: ex post insolvency and the possibility of designing “double impact” innovations (capable of reducing both the cost of prevention and the probability of accidents). Contrary to Endres et alii, we show that strict liability and negligence rules have different impacts on behaviour. Performance of the negligence rule depends on the type of innovation developed and on the regulator’s behaviour. |
