| Summary, etc. | Les bouleversements que connaît la famille ont-ils des répercussions sur le droit rural ? Le droit rural défend-il toujours le modèle de l’exploitation agricole de type familial ? C’est à deux questions que l’article s’efforce de répondre en abordant l’exploitation agricole familiale sous ses deux angles, objet et objectif du droit rural.Le droit rural ne prend pas en compte les nouveaux modes de conjugalités à propos des règles juridiques organisant l’activité mais aussi la transmission du patrimoine agricole et une évolution de la législation apparaît à cet égard inéluctable. La défense de l’exploitation agricole de type familial n’est plus un objectif prioritaire du droit rural et un certain nombre de leçons pourrait en être tirés par le législateur rural, comme la création d’un fonds rural, et une certaine patrimonialisation du droit rural. |

| Summary, etc. | Do the upheavals families go through have any repercussions on rural law? Does rural law still defend the family farms model?This article attempts to answer these two questions by examining family farming from two viewpoints – as the object and objective of rural law.Rural law does not take new styles of conjugal life into account, both in terms of the laws which regulate this activity and the inheritance of property – a change in legislation thus seems inevitable.The defence of family-style farming is no longer one of the main objectives of rural law, and a certain number of lessons can be learned by the rural legislator, such as the creation of a rural fund, and a legal recognition of the economic value of certain rights. |
