Summary, etc. RésuméLe régime des terres de l’Italie républicaine repose sur deux constantes qui ont marqué les paysages : la limitatio et le rapport entre terres privées et publiques. La conquête et le sort des terres des vaincus ont multiplié les intermédiaires entre ces deux situations. Toutes ces terres n’étaient pas passées en pleine propriété aux seuls citoyens romains. Les colonies latines, étrangères à la citoyenneté complète, forment un cas particulier, par le nombre important de colons installés et par l’ampleur des lots distribués. Des « vaincus » ont conservé ou retrouvé leurs terres. La période de la Guerre sociale (90-88 avant J.-C.) et l’organisation municipale provoquèrent une réorganisation du droit, sans faire cesser la multiplicité des régimes. La limitatio ne s’est pas imposée partout. L’autorité juridique qui s’est exercée sur les terres des colonies, des municipes, des préfectures, des oppida et fora a dû tenir compte de la diversité des situations foncières et des droits qui préexistaient à la conquête.

Summary, etc. Two permanent elements, limitatio and the ratio of private holdings to public ones, underpinned landholding structures in Italy during the Roman Republic, and have influenced Italian landscapes. The conquest and ulterior fate of lands belonging to defeated people multiplied intermediary situations, neither privare nor public. They did not lose all their lands to full ownership of exclusively Roman citizens. Thus latin colonies, which did not benefit from full citizenship, constituted an exceptional case, both by the significant number of settlers and by the size of the granted landholdings. Also, « defeated » individuals kept or gained back possession of their lands. The Social War (90-88 b.c.) and municipal reorganization brought about a restructuring of landholding law, but did not do away with the multiplicity of situations. Limitatio did not become universally applicable. The variety of landholding situations as well as rights preexisting to the Roman conquest were incorporated in the legal land rules enforceable in colonies, in municipal or prefectoral areas, or in oppida and fora.
