| Summary, etc. | « L’éthique de l’humanité » contenu dans le droit de l’espace extra-atmosphérique (EEA) a pour antonyme le nomos et le polemos selon Carl Schmitt, c’est-à-dire l’idée que le droit (international) et le politique ont pour noyaux respectifs le partage territorial et la relation d’hostilité, tous deux trouvant à se combiner dans la conquête, au sens de la prise de possession d’un territoire par l’emploi de la force armée. La grande question est de savoir si l’EEA échappe, ou échappera, au nomos et au polemos, ou s’il connaît, ou connaîtra, lui aussi, la lutte pour la domination. Afin de répondre à cette question, l’article examine le droit de l’EEA en matière militaire ; puis « l’éthique de l’humanité » vis-à-vis du nomos et polemos ; enfin la militarisation et de l’arsenalisation de l’EEA, sous l’angle des défenses antimissiles et du rapport à la dissuasion nucléaire, soit l’essentiel de la problématique de défense dans l’EEA. |

The big question is knowing if outer space escapes or will escape the nomos and polemos, or if it also experiences or will experience the struggle for domination. In order to answer this question, the article examines outer space law concerning the military; then ‘the ethics of mankind’ vis-à-vis nomos and polemos; finally the militarisation and arsenalisation of outer space, from the angle of anti-missile defences and the relationship to nuclear dissuasion, ie the essence of the problem of defence in outer space. |
