| Summary, etc. | Cet article vise à voir en quoi le « marché intérieur » a constitué la base du développement d’un dialogue social à un niveau communautaire, en aboutissant à poser les bases d’un droit communautaire du travail. Il revient pour cela sur la portée institutionnelle du « marché intérieur » par rapport à celle du « marché commun » visé initialement par le traité de Rome. Ce concept de « marché intérieur » est en effet issu d’un débat technique sur la mise en œuvre des traités antérieurs et devient le motif justifiant l’adoption d’un nouveau traité, dit de l’Acte unique, renforçant les prérogatives de la Commission et instituant le vote du Conseil à la majorité qualifiée. Simultanément, le « marché intérieur », comme constat d’une réalité émergente, est saisi par les partenaires sociaux comme le cadre général permettant d’initier une discussion dépassant l’affrontement sur les politiques nationales et s’attaquant à des enjeux européens. Au-delà d’un mécanisme abstrait d’ajustement de l’offre et de la demande, le marché intérieur circonscrit en effet un espace ouvert à une action législative de niveau communautaire. Les partenaires sociaux et la Commission passent ainsi au cours des années 1980, du constat à une activité de propositions législatives qui se concrétiseront au cours de la décennie suivante. |

| Summary, etc. | This article aims at assessing the way the « Single Market » has been the ground of the development of a Social Dialogue and thus of a European labour legislation. It considers the institutional impact of the « Single Market » as compared to the « Common Market » initially designed by the Rome Treaty. The concept of « Single Market » was actually the result of a technical debate on the implementation of the former treaties. It has become a motive for the adoption of a new treaty, the « Single Act Treaty » that reinforced the prerogatives of the Commission and instituted the qualified majority vote for the Council. As a statement of an emerging reality, the « Single Market » is then taken as a general frame for discussions between the social partners overcoming the national policy level and tackling European issues. Beyond an abstract mechanism of adjustment between demand and supply, the « Single Market » defined a space for a legislative action at the European level. The social partners and the Commission evolved during the 1980’s from common statements to legislative propositions that became concrete during the next decade. |
