| Summary, etc. | L’objectif de cet article est de revenir sur les mobilisations associées aux nouvelles règles qui ont prétendu encadrer le financement de la vie politique française, et plus spécialement certaines ressources d’origine privée : les dons des entreprises. Entre la fin des années 1980 et le milieu des années 1990, ces financements, d’abord occultes, furent soudain légalisés avant d’être de nouveau prohibés. L’analyse de ce processus livre un nouvel éclairage de ces brusques revirements. Elle montre combien la collecte et la gestion de telles ressources reflètent de sérieuses inégalités entre candidats. L’étude des débats parlementaires réformant cet enjeu lié au financement politique nous permet de pénétrer le sens pratique des députés impliqués dans ces réformes politiques. Finalement, l’examen du contexte de la prohibition des dons d’entreprises nous aide à comprendre comment les règles en matière de divulgation jouèrent un rôle important dans ce changement de cap. Par la suite, la mise en œuvre de ces nouvelles règles fut à l’origine d’incertitudes (progressivement tranchées par les juridictions), faisant naître dans le même temps d’autres manières de contourner les lois. Au final, toute l’enquête constitue plus généralement une occasion de poser la question du tracé fluctuant de la frontière symbolique entre sphère politique et milieux d’affaires ou cercles socio-économiques. |

| Summary, etc. | The Financing of the French Political Life by Corporate Donations 1970-2012The purpose of that contribution is to go back over the mobilizations linked to the new regulations which pretended to frame the funding resources of the French political life, and particularly some of those coming from private origins : the corporate donations. Between the end of the 1980 and the mid 1990, these financing, first hidden, became suddenly legal, before being again prohibited. The analysis of that process sheds new lights on those abrupt reversals. It shows how the collect and the management of such resources reveal serious inequalities between candidates. The survey of the parliamentary debates reforming that issue related to political finance let us understand the “practical-minded” of the French MP’s involved in those political reforms. Finally, the analysis of the context of the prohibition of the corporate donations helps us to realize how disclosure regulations took an important role in that change of course. Afterwards, the implementation of the new regulations revealed itself at the origin of uncertainties (progressively bring to a close by the jurisdictions), giving birth at the same time to other ways of circumventing the laws. At last, the entire enquiry is also more generally an opportunity to raise the question of the layout of the symbolic changing boundary between the political sphere and business or the socio-economical circles. |
