| Summary, etc. | Les changements climatiques constituent un risque global difficilement appréhendé par les régimes traditionnels de responsabilité. Le vaste contentieux climatique qui se développe actuellement dans de nombreux États, mais aussi aux niveaux régional et international, conduit à l'émergence de solutions communes aux différentes juridictions qui esquissent les éléments d'un régime de responsabilité globale pour risque climatique. Ces recours concernent aussi bien les entreprises que les États, mais nous nous intéressons ici spécifiquement à la responsabilité de l'État pour négligence dans le contrôle des activités polluantes dans son domaine de compétence. La responsabilité climatique se caractérise ainsi par la prise en compte du lien entre l'État et le risque, d'un dommage probable et par sa fonction anti-cipatoire. Elle pourrait à terme constituer un modèle pour la responsabilité de l'État à l'égard d'autres types de risques globaux. |

| Summary, etc. | Climate change constitutes a global risk difficult to capture within traditional liability regimes. The vast climate litigation currently developing in many States, but also at regional and international levels, is leading to the development of common solutions for the different jurisdictions that outline the elements of a global liability regime for climate risk. These remedies concern companies as well as States, but we are specifically interested here in the responsibility of the State for negligence when controlling polluting activities in its area of accountability. Climate responsibility is thus characterized by taking into account the link between State and risk, probable damage and by its anticipatory function. It could ultimately constitute a model for the State's responsibility where other types of global risks are concerned. |
