| Summary, etc. | RésuméLa ségrégation des juifs dans des ghettos, qui s’imposa comme une véritable technique de gouvernement dans certains États de la péninsule italienne à partir du xvie siècle, avait, pour les acteurs juifs et chrétiens, de nombreuses implications souvent imbriquées : politiques et idéologiques, économiques et sociales, spatiales, institutionnelles et juridiques. Discriminés et assignés à résidence dans des quartiers séparés et circonscrits, les juifs étaient notamment condamnés à devenir d’éternels locataires de leurs habitations. En effet, la ghettoïsation allait presque partout de pair avec un certain nombre de discriminations, comme l’interdiction de posséder les immeubles. De cette situation particulière émergea un droit particulier, le jus chazakah. Cette forme de propriété dissociée, que cet article se propose d’appréhender à travers une approche comparative où Rome et les États de l’Église occupent une place centrale, constitue un véritable laboratoire pour étudier aussi bien l’histoire d’une minorité que son rapport au groupe majoritaire et, plus largement, la complexité même des sociétés d’Ancien Régime. Le ghetto était un espace certes contraint et contraignant, mais toujours négocié par des minorités juives capables de mobiliser les différentes ressources économiques et juridiques à leur disposition pour négocier leurs droits, et ce même dans un contexte de plus en plus hostile. |

| Summary, etc. | The segregation of Jews in ghettos, which became a veritable technique of government in some states of the Italian Peninsula from the sixteenth century onward, had various implications for both Jewish and Christian actors. These implications were often intertwined, and could be political and ideological, economic and social, spatial, institutional, and legal. Effectively placed under house arrest in separate and confined quarters, Jews were condemned to become eternal tenants of their rented homes. Indeed, ghettoization was generally associated with other discriminations, such as the ban on owning buildings. From this particular situation emerged a specific kind of legal right, the jus chazakah. This article proposes to explore this dissociated form of ownership through a comparative approach in which Rome and the State of the Church occupy a central place, showing that it provides a veritable laboratory for studying both the history of a minority and its relationship to the majority group and, more broadly, the complexity of early modern societies. The ghetto was certainly a constrained and constraining space, but it was always negotiated by Jewish minorities capable of mobilizing the economic and legal resources at their disposal to negotiate their rights, even in an increasingly hostile context. |
