| Summary, etc. | Cet article porte sur des crimes ayant eu lieu en Algérie et au Soudan, crimes qui ont fait l’objet de tentatives de règlement par conciliation ( sulh en arabe) et paiement du prix du sang ( diya). La question de l’intentionnalité s’est révélée centrale et en même temps peu explorée par les anthropologues travaillant sur les procédures de conciliation et sur le prix du sang. Dans la théorie et dans les jurisprudences islamiques, une action définie comme non intentionnelle ( ghir ‘amdiyi) implique réconciliation et paiement du prix du sang. Elle suppose plus facilement l’octroi du pardon. Mes recherches ont montré que le prix du sang était plus facilement accepté dans les cas d’homicides accidentels. Cependant, des homicides considérés a priori comme intentionnels ( ‘amdiyi) pouvaient conduire à des réconciliations. Cette contradiction m’a amené à m’intéresser davantage à cette notion d’intentionnalité : comment et pourquoi des actions peuvent-elles être définies et interprétées comme intentionnelles ou non intentionnelles ? |

| Summary, etc. | This paper focuses on criminal cases encountered in Algeria and Sudan, which were settled through conciliation (sulh in Arabic) and blood money (diya ) practices. During my research, the issue of intentionality was a central one. However, anthropologists working on conciliation and blood money have seldom discussed this. In theory, and in Islamic normativities, an action defined as unintentional (ghir ‘amdiyi ) leads to reconciliation and blood money compensation. It presupposes more easily the granting of forgiveness. Indeed, my research shows that blood money was easily accepted in cases of accidental homicide. However, homicide considered a priori as intentional (‘amdiyi ) leads to reconciliation where as homicide considered a priori as accidental or unintentional does not. This contradictory reality led me to explore the notion of intentionality: how and why are actions defined and interpreted as intentional or unintentional? |
