| Summary, etc. | Pouvanaa a Oopa, leader politique polynésien autonomiste, ancien député et sénateur, condamné en 1959 à huit années de réclusion pour tentative d'incendie de la ville de Papeete a été réhabilité, plus de quarante ans après sa mort. La Cour de révision et de réexamen des condamnations pénales, saisie par la garde des Sceaux en juin 2014, a déchargé la mémoire du mort par un arrêt rendu le 25 octobre 2018 qui a eu un grand retentissement en Polynésie française où il était très attendu tandis qu'il est presque passé inaperçu en Métropole. Cet article se propose de revenir sur cette affaire qui marqua fortement l'histoire des relations entre la France et la Polynésie, d'exposer le processus qui aboutit à cette révision, à bien des égards exceptionnelle, et de l'inscrire dans une réflexion plus globale sur la révision des condamnations pénales pour tenter d'en mesurer la portée juridique, politique et symbolique. |

| Summary, etc. | The name of Pouvanaa a Oopa, a Polynesian separatist political leader, former member of parliament and senator, sentenced in 1959 to eight years'imprisonment for attempted arson of the city of Papeete, was finally cleared more than forty years after his death. The case was brought before the Court of review and re-examination of criminal convictions by the Minister for Justice in June 2014, and the deceased leader's name was cleared by a judgment promulgated on 25 october 2018 ; this had a great impact in French Polynesia, where the ruling was highly anticipated, but went nearly unnoticed in mainland France. The aim of this article is to return to this case, which strongly marked the history of relations between France and Polynesia, in order to expose the process that led to this act of legal review, in many ways an exceptional one, and to situate the case in a broader context of the legal review of criminal convictions in an attempt to measure its legal, political and symbolic scope. |
