Elle se caractérise par une multiplicité des ordres juridiques et des traditions constitutionnelles nationales, qu'il faut articuler ensemble, tout en préservant l'identité de chaque ordre juridique. Le juge occupe une place essentielle dans cette articulation, en organisant la dialogique de la justice européenne. En assumant la complexité résultant de cette multiplicité, le juge est investi d'un rôle moteur dans la réalisation de la justice européenne, conçue comme prolongement d'une Europe unie dans la diversité, et rendue accessible aux citoyens, que ceux-ci défendent leur intérêt individuel ou des intérêts collectifs qui les dépassent. |
