| Summary, etc. | A free commentary on the practice of correctional hearingsCriminal hearings are public meetings at which charges and, where appropriate, the awarding of damages are debated. What matters is the manner in which hearings are prepared and conducted, and the reasons given for the decisions. This article seeks to shed light on this process, which is all too rarely explained. Written in the first person, it is the fruit of a personal reflection without claiming to propose a specific methodology for judgement. Its sole purpose is to shed light on the act of judging in a given situation. By giving us a behind-the-scenes insight into the activities of a criminal court judge, it follows on from the article entitled “L'audience c'est ici et maintenant” (The Hearing is Here and Now), published in issue 2024/2 (“Les langues du procès”) of Cahiers de la justice. |

| Summary, etc. | Une audience pénale est une réunion publique où l'on débat d'une accusation et le cas échéant d'un préjudice. Ce qui importe est la manière de préparer l'audience, de la conduire et de motiver son jugement. C'est à cette tâche trop rarement explicitée que cet article s'emploie. Œuvre d'un praticien exerçant principalement dans une chambre spécialisée dans les délits économiques et financiers, écrite à la première personne, il est le fruit d'une réflexion personnelle sans prétendre proposer une méthodologie du jugement. Son seul but est d'éclairer l'acte de juger en situation. En nous faisant entrer dans l'atelier du juge d'un tribunal correctionnel, il s'inscrit dans le droit fil de l'article intitulé « L'audience c'est ici et maintenant » publié dans le numéro 2024/2 (« Les langues du procès ») des Cahiers de la justice. |
